1. Acceptance of these terms

By accessing the Mercurion Labs website or using a Mercurion Labs product or service, you agree to these Terms of Service and any product-specific agreement that applies to your use. If you do not agree, do not use the website or service.

2. About Mercurion Labs and Mercury Reach

Mercurion Labs, LLC builds communication systems for time-sensitive work. Mercury Reach is a resident communication platform used by property teams to send operational notices by text message and voice, translate notices, and manage replies and delivery history.

3. Mercury Reach messaging program

The Mercury Reach Resident Notices messaging program delivers property- and community-related information requested or authorized by a participating property manager or housing provider. Messages may include emergency alerts, maintenance updates, inspection notices, rent reminders, community operations, and other service-related notifications. Messages are informational and are sent only after the recipient has provided the consent required for that sender and message purpose.

5. Opting out and getting help

To stop text messages, reply STOP at any time. You may receive one final message confirming your opt-out. No further messages will be sent from that messaging program unless you opt in again.

For help, reply HELP to the number that sent the message or visit the Mercury Reach Help Center.

6. Consent and sender responsibilities

Property managers, housing providers, and other Mercury Reach customers are responsible for obtaining and retaining valid consent before sending messages, identifying themselves as the sender, limiting messages to the agreed subject matter, honoring opt-outs, and complying with applicable laws, carrier requirements, and messaging standards. Consent may not be bought, sold, rented, or transferred.

7. Privacy

Our handling of personal information, mobile numbers, and messaging consent is described in the Mercurion Labs Privacy Policy. Mobile phone numbers and text messaging opt-in data and consent are not shared with third parties or affiliates for marketing or promotional purposes.

8. Acceptable use

You may not use the website or services to:

• send unlawful, deceptive, abusive, unsolicited, or unwanted communications;
• contact anyone without the consent required for the sender and message purpose;
• evade opt-out requests, carrier controls, or messaging safeguards;
• attempt unauthorized access, disrupt service, or introduce malicious code; or
• violate applicable law, another person’s rights, or a carrier or provider policy.

9. Service providers and delivery

Mercurion Labs uses communications and infrastructure providers, including Twilio, to operate Mercury Reach. Delivery depends on networks and systems outside our control. Wireless carriers are not liable for delayed or undelivered messages. We do not guarantee that every message or call will be delivered without interruption or delay.

10. Intellectual property and third-party links

The website, products, branding, text, graphics, and software are owned by Mercurion Labs, LLC or used with permission. These terms do not grant ownership of that content. Links to third-party sites are provided for convenience; Mercurion Labs does not control their content, availability, security, or practices.

11. Disclaimer and limitation of liability

The website and services are provided “as is” and “as available.” To the fullest extent permitted by law, Mercurion Labs disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Mercurion Labs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from access to or use of the website or services. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

12. Changes and applicable law

Mercurion Labs may update these terms from time to time. Updated terms take effect when posted with a revised effective date. These terms are governed by applicable law, without regard to conflict-of-law principles. Rights or remedies that cannot lawfully be limited remain unaffected.
